Terms of Service

These terms are the agreement between you and Holler AI LLC ("Holler," "we," "us") for use of the Holler service at hollerdesk.com. By creating an account or using the service, you agree to them.

The service

Holler is an AI answering service. We provide your business with a dedicated phone number, answer calls that forward to it, speak with callers using an AI voice assistant configured from the information you give us, capture caller details and transcripts, notify you by text and email, and — on plans that include it — book appointments on the calendar you connect. Specific features depend on your plan.

Holler is a communications tool. It is not a legal, medical, financial, or professional advisory service, and the assistant does not act as your agent for entering contracts on your behalf.

Your account and your setup

You must be at least 18 and authorized to act for the business you register. You are responsible for the accuracy of the business information, hours, services, pricing, and answering rules you configure — the assistant speaks from what you tell it. Keep your login credentials secure; you are responsible for activity under your account.

Acceptable use

You agree not to use Holler to:

  • Place or receive calls or texts in violation of the TCPA, CAN-SPAM, state telemarketing rules, or carrier requirements.
  • Send unsolicited marketing, robocalls, or bulk messaging campaigns.
  • Impersonate another business or person, or misrepresent who is calling.
  • Collect or handle payment card data, protected health information, or other sensitive categories through the assistant.
  • Engage in fraud, harassment, or anything unlawful, or facilitate discrimination prohibited by law.
  • Resell, sublicense, reverse engineer, scrape, or overload the service.

You are responsible for complying with call-recording consent laws in your state and your callers' states. We may suspend or terminate accounts that violate this section or create risk for our carriers.

Billing and cancellation

Plans are billed in advance on a monthly or annual basis at the price shown at checkout, plus applicable taxes. Subscriptions renew automatically until cancelled.

Cancel anytime. You can cancel from your dashboard. Cancellation takes effect at the end of the current billing period; we do not prorate partial periods, and fees already paid are non-refundable except where required by law. Usage beyond your plan's included allowance may be billed as overage at the rate disclosed in your account.

Important on cancellation: disabling Holler does not change your phone carrier's settings. You must turn off call forwarding on your own line when you cancel. If you leave forwarding enabled after your account ends, calls may fail or reach a disconnected number, and Holler is not responsible for calls missed as a result.

We may change prices with at least 30 days' notice before the change applies to your next renewal.

Not for emergencies

Holler is not an emergency service and cannot be used to contact 911 or any emergency responder. Do not use Holler as a line for emergency dispatch, medical triage, crisis response, or life-safety monitoring. If a caller has an emergency, they must hang up and dial 911 from a phone that can reach emergency services.

AI limitations and disclaimers

The assistant is automated software. It can mishear a caller, transcribe a name or number incorrectly, misunderstand a request, or produce an inaccurate summary. Voice, telephony, and internet services can also be interrupted. You should verify important details — especially callback numbers, addresses, and appointment times — before acting on them.

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, error-free, or capture every call.

Limitation of liability

To the maximum extent permitted by law, Holler will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, lost revenue, lost data, or missed or mishandled calls, appointments, or leads — even if we were advised such damages were possible.

Our total aggregate liability arising out of or relating to the service is limited to the amount you paid Holler in the three (3) months immediately preceding the event giving rise to the claim.

Indemnity

You agree to indemnify and hold Holler harmless from claims, damages, and costs (including reasonable attorneys' fees) arising from your use of the service, the content of your calls and messages, your business information, or your violation of these terms or applicable law.

Your data

You own your business information and your call records. We process them as described in our Privacy Policy, which is part of these terms. You grant us the license needed to operate the service on your behalf.

Suspension and termination

We may suspend or terminate the service for non-payment, violation of these terms, or risk to our platform or carriers. You may stop using the service at any time. Sections on billing, disclaimers, liability, indemnity, and governing law survive termination.

Changes to these terms

We may update these terms; the date at the top will change and we will notify account holders of material changes. Continued use after the effective date means you accept the updated terms.

Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Kentucky, and both parties consent to that jurisdiction and venue.
